By accessing, checking the consent box, completing verification steps, and submitting your application through Orion ("Platform"), you ("Borrower") expressly acknowledge, understand, and agree to be bound by the following Terms and Conditions:
1.1 Technology Matchmaker / Directory Only: Orion is strictly an independent online technology platform and lead distribution service connecting prospective borrowers with third-party, KPKT-licensed Credit Community money lenders operating in Malaysia under the Moneylenders Act 1951. Orion is NOT a financial institution, money lender, credit broker, debt collector, or financial adviser.
1.2 No Offer, Approval, or Guarantee: Publication of loan request forms on this Platform does not constitute a guaranteed offer, approval, or solicitation of credit. All loan approvals, interest rates, repayment terms, and statutory loan agreements (Form J/Form K) are determined solely at the discretion of independent money lenders.
2.1 Zero Liability for Lender Acts or Misconduct: Orion shall NOT be held liable or responsible for any unauthorized contact, unsolicited calls/SMS/messages (spam), harassment, predatory lending, or illegal practices conducted by lenders or third parties contacting you through or outside the Platform.
2.2 Independent Contracts: Any loan contract, financial transaction, or repayment agreement entered into is strictly a bilateral contract between you and the respective licensed money lender. Orion is not a party to, nor liable for, any disputes, defaults, breaches, or illegal demands arising from such agreements.
2.3 No Upfront Fee Warning: Orion and legitimate KPKT-licensed lenders will NEVER ask borrowers for upfront processing fees, "runner fees", or deposit transfers prior to loan disbursement. You agree to hold Orion harmless against any losses incurred if you pay upfront funds to third-party scammers.
3.1 "As-Is" Service Provision: The Platform, its forms, APIs, and data infrastructure are provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory.
3.2 Absolute Hold Harmless for Cybersecurity Incidents: To the fullest extent permitted under Malaysian law, you expressly waive any right to sue, initiate arbitral proceedings against, or claim monetary damages from Orion, its operators, founders, directors, or hosting providers for:
4.1 Data Processing & Distribution Consent: Pursuant to the Personal Data Protection Act 2010 (PDPA), you grant explicit consent to Orion to collect, process, and transmit your personal details (MyKad IC, contact info, location coordinates, income band) to matched KPKT-licensed lenders within a 10km spatial radius.
4.2 Biometric e-KYC Consent: You authorize the capture and biometric analysis of your MyKad scans and liveness video recordings for identity verification and anti-fraud compliance.
5.1 Pursuant to Section 24 of the Credit Reporting Agencies (CRA) Act 2010, you grant permission to Orion and its network of matched licensed lenders to conduct credit evaluations and retrieve credit reports from registered agencies (including CTOS Data Systems Sdn Bhd and CCRIS databases).
6.1 Pursuant to the Electronic Commerce Act 2006, checking the "I Agree" box and pressing "Submit Request" constitutes a valid, legally binding electronic signature.
6.2 Your IP address, device user-agent string, verification timestamps, and legal consent logs will be permanently stored in our secure audit trail to establish legal consent.
