By submitting an application to join Orion, checking the consent box, uploading verification documents, or accessing borrower leads through the Platform, you ("Lender" / "Credit Community") expressly acknowledge, understand, and agree to be bound by the following Terms and Conditions:
1.1 Technology Directory Only: Orion is strictly an independent online lead discovery and matching directory connecting prospective borrowers with KPKT-licensed Credit Community money lenders operating in Malaysia under the Moneylenders Act 1951. Orion is NOT a credit broker, financial adviser, guarantor, debt collector, or party to any credit facility.
1.2 No Guarantee of Lead Validity or Business Volume: Orion makes no representations, warranties, or guarantees regarding the accuracy, creditworthiness, financial standing, employment status, or intent of any borrower leads distributed through the Platform.
2.1 Zero Liability for Loan Default or Losses: Orion shall NOT be held liable or responsible for any loan defaults, non-payments, fraudulent applications, forged borrower documents, financial losses, legal costs, or damages arising from any credit transaction entered into with a borrower.
2.2 Independent Underwriting Responsibility: All loan evaluations, background checks, credit risk assessments, liveness verifications, and execution of statutory loan agreements (Form J/Form K) are solely the legal and operational responsibility of the Lender.
2.3 No Upfront Fee & Fair Practice Covenant: The Lender expressly covenants and agrees that it shall NEVER demand, solicit, or collect upfront processing fees, runner fees, or deposit transfers from any borrower prior to loan disbursement. Breach of this covenant will result in immediate blacklisting and reporting to KPKT and PDRM.
3.1 "As-Is" Service Provision: The Platform, its APIs, and document storage services are provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
3.2 No Suit / Absolute Hold Harmless for Infrastructure Failures: To the fullest extent permitted under Malaysian law, you expressly waive any right to sue, initiate arbitral proceedings against, or claim monetary damages from Orion, its operators, directors, or hosting providers for:
4.1 Warranties of Valid Licensing: The Lender warrants that it possesses a valid, active money lending license issued by the Ministry of Housing and Local Government (KPKT) under the Moneylenders Act 1951 and that all submitted SSM and license documents are genuine.
4.2 PDPA Data Handling: The Lender agrees to process all personal data received from Orion strictly in accordance with the Personal Data Protection Act 2010 (PDPA) and solely for evaluating the specific loan request. Personal data shall not be resold, disclosed to unapproved third parties, or used for unauthorized marketing.
5.1 You grant Orion explicit permission to store, process, and apply internal verification watermarks to all uploaded KPKT licenses, SSM certificates, and MyKad identity scans for compliance and audit logging purposes.
